1. Introduction & Acceptance
Welcome to MedCart Kenya. These Terms and Conditions ("Terms") govern your use of our website, mobile platform, and services (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Services.
2. Definitions
- "MedCart" or "we/us/our" refers to MedCart Kenya, a licensed online pharmacy registered with the Pharmacy and Poisons Board of Kenya.
- "User" or "you/your" refers to any individual who accesses or uses our Services.
- "Products" refers to all medicines, health products, supplements, medical devices, and other items available for purchase on our platform.
- "Services" refers to all services provided by MedCart, including but not limited to product sales, delivery, pharmacist consultation, and customer support.
3. Account Registration
To place orders on MedCart, you may be required to create an account. You agree to:
- Provide accurate, current, and complete information during registration
- Maintain the security and confidentiality of your account credentials
- Notify us immediately of any unauthorized use of your account
- Accept responsibility for all activities that occur under your account
We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent activity.
4. Products & Pricing
All product prices on MedCart are displayed in Kenyan Shillings (KES) and include applicable taxes unless otherwise stated. We strive to ensure pricing accuracy; however, prices are subject to change without prior notice. In the event of a pricing error, we reserve the right to cancel the order and notify you of the correct price.
Product availability is subject to stock levels. We reserve the right to limit quantities on any product and to discontinue products at any time.
5. Prescription Products
Certain products on our platform require a valid prescription issued by a licensed healthcare professional in Kenya. When ordering prescription products, you must:
- Upload a clear, legible copy of your valid prescription
- Ensure the prescription is current and has not expired
- Provide accurate patient information matching the prescription
All prescriptions are verified by our licensed pharmacists before dispensing. We reserve the right to decline any prescription that cannot be verified, appears altered, or does not meet regulatory requirements. Prescription medications will not be dispatched until pharmacist verification is complete.
6. Orders & Payment
Placing Orders
By placing an order, you are making an offer to purchase the selected products. An order confirmation email does not constitute acceptance of your order. We reserve the right to accept or decline any order at our discretion.
Payment Methods
We accept the following payment methods:
- M-Pesa: Mobile money payments via Safaricom M-Pesa
- Visa: Visa debit and credit cards
- MasterCard: MasterCard debit and credit cards
All payments are processed securely through our authorized payment partners. You agree that the payment information you provide is accurate and that you are authorized to use the payment method.
7. Delivery
We offer the following delivery options:
- Standard Delivery: 2-4 business days for locations across Kenya
- Express Delivery: Same-day delivery available within Nairobi for orders placed before 12:00 PM
- Free Delivery: Orders above KES 2,500 qualify for free standard delivery
Delivery timelines are estimates and may vary depending on your location, product availability, and other factors beyond our control. We will make reasonable efforts to deliver within the stated timeframes and will notify you of any significant delays.
8. Returns & Refunds
Return Policy
We accept returns within 7 days of delivery, provided the product meets the following conditions:
- The product is unused, unopened, and in its original packaging
- You provide proof of purchase (order number or receipt)
- The return is initiated through our customer support team
Exceptions
The following products are not eligible for return:
- Prescription medications that have been dispensed
- Opened or used personal care and hygiene products
- Products with broken seals or tampered packaging
- Refrigerated or temperature-sensitive items
- Products purchased during clearance sales (unless defective)
Refunds
Approved refunds will be processed within 7-14 business days to the original payment method. For M-Pesa payments, refunds will be credited to the M-Pesa number used for the transaction.
9. Intellectual Property
All content on the MedCart website, including but not limited to text, graphics, logos, images, product descriptions, and software, is the property of MedCart Kenya or its licensors and is protected by intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content without our prior written consent.
10. Limitation of Liability
To the fullest extent permitted by law, MedCart Kenya shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of our Services. Our total liability for any claim shall not exceed the amount you paid for the specific product or service giving rise to the claim.
We do not provide medical advice through our platform. Product descriptions and health information are provided for informational purposes only and should not substitute professional medical advice. Always consult a qualified healthcare professional before starting any medication or treatment.
11. Governing Law
These Terms shall be governed by and construed in accordance with the Laws of Kenya. Any disputes arising from or related to these Terms or your use of our Services shall be subject to the exclusive jurisdiction of the courts of Kenya.
